This deponent, Anthony Gay, maketh oath that the plantation in Ferryland in Newfoundland, commonly called by the name of the "Pool Plantation", was in the years 1688, 1689, and 1690 enjoyed by Mr. Phillip Kirke, by the right and leave of Mr. David Kirke, an elder brother, as he has often heard them dispute (the deponent being servant to the said Phillip Kirke). And further declareth that the first winter he, the said deponent, was there, being in the year 1688 upon building of warehouses or storehouses upon the premises aforesaid, that Mr David Kirke was the sole manager thereof. And further declareth that no elder or younger of the aforesaid David Kirke [II] [i.e. neither George Kirke nor Phillip or Jarvis Kirke] of the aforesaid David Kirke [II] did ever, to the best of his knowledge, ask demand or receive and rent or acknowledgement for said plantation, but that the said plantation was solely and justly the right of the aforesaid David Kirke [II] and further this deponent saith not.
